Terms and ConditionsHeritage Motor Coach Resort & Marina, a Land Condominium Rental Terms & Conditions: I, the undersigned (whether one or more persons), do hereby acknowledge and agree that, in consideration of my occupancy of a unit at Heritage Motor Coach Resort & Marina, a Land Condominium (the “Condominium”), I and all of my family members and guests who will accompany me for my stay at the Condominium (collectively, the “Occupants”) covenant and agree that the stay of the Occupants at the Condominium will be subject, in all respects, to the following terms and condition: Payment will be processed at Check-In on Arrival Date unless Web Reservation was made. Cancellation Policy: Reservations may be cancelled up to 48 prior to Arrival Date without incurring a cancellation fee. Any no shows or cancellations made less than 48 hours prior to Arrival Date will be charged a cancellation fee equal to one night`s stay. Check in time is between 11:00AM-5:00PM CST and check out is by 11:00 AM CST. An early check-in or late check-out is available for a fee. PLEASE RETURN ALL GATE KEY CARDS BEFORE DEPARTURE The “Coach Houses” or “Casitas” on each site are not included with the rental of the unit. 11% Lodging Tax is not included in nightly rate and will be charged in addition to the quoted nightly rates along with a $5.00 processing fee which is added to each reservation Do your best to pull your Coach back as far as possible on your assigned pad. Please do not place your garbage on the curb or in front of your unit. All garbage needs to be placed in garbage bags (NO LOOSE GARBAGE) and taken over to the Clearly Marked Trash Depository which is located near the Exit Gate. Our streets are one way. Please do not exit through the entrance gate even if it is open. The exit gate will open automatically when you get close to it. The speed limit on all streets within the Condominium is 10 miles per hour. Please obey. People may be walking in the street. No parking on the streets anywhere in the Condominium except long enough to hook or unhook your tow vehicle. All common areas of the Condominium are non-smoking. Occupancy may not exceed 6 people per coach over 2 years in age. There is a charge for 5th & 6th persons, please refer to our rental rate sheet. Any outside guests visiting you during your stay here are limited to a maximum of 2 people at a time and they MUST register at Office. You are welcome to enjoy the laundry and exercise rooms of the Clubhouse at any time. Please leave it clean and NO SMOKING INSIDE ANY BUILDING The Owner’s Lounge at the Clubhouse is permitted for Unit Owners only and not included in the rental of your unit. Pool and Spa hours are 10:00AM-10:00PM with ADULT ONLY hours from 8:00PM-10:00PM. Any children under the age of 14 must be accompanied by an adult 21 years or older. As in any high quality resort, do not hang anything outside. This includes towels, clothing, tarps, etc. Also, party lights or yard décor are not permitted. We understand that many of you have close ties to Universities, your home State, and this great country. However, no flags or banners of any kind are to be flown inside the resort. Open fires that may give off a spark are NOT allowed on your site. Join us on the upstairs fire pit pavilion instead. Please come and meet the other guests and owners. Gas or propane grills are allowed. Boats, Fishing charters or other things of this kind are prohibited from picking guests up at our marina/dock. If you have a visitor with a boat or if you yourself have a boat you must rent an assigned boat slip from the Office at a charge of $25 per day. Parking of the boat will only be allowed in that assigned slip-no tying up at dock, etc. You may enjoy the walkway out to the marina and the dock but are prohibited from being on any of the finger piers or being near any of our Owner’s boats. All items on marina (such as fish cleaning stations, storage cabinets, etc) are not available for use as they are privately owned. You may not clean fish or cut up bait anywhere on the property except at your resort site (This includes but is not limited to the Marina/Dock, Bath Houses, etc) AFTER HOURS EMERGENCY CONTACT: Jim Howard 541-525-1378 CLUBHOUSE DOOR CODES: 0013 PEDESTRIAN GATE CODE: 0136X The following breeds of dogs are prohibited from resort: Pit-bull, Rottweiler, full size Doberman Pincher’s. ALL animals are to be kept on leash when in resort and you are required to clean up after them. Any unruly or excessively aggressive animal will be asked to be removed from resort. Any failure to pick up your pets waste could result in eviction from the resort. There are 4 receptacles throughout resort as well as a Trash Depository near the Exit Gate. Any and all “rules” are in place in order that everyone here can enjoy themselves in this truly unique resort. Please be a good neighbor and use common sense in any situation not mentioned here. All Occupants shall at all times abide by the Rules and Regulations Concerning the Use of the Condominium, as adopted and/or amended from time to time (the “Rules”), by Heritage Motor Coach Resort & Marina Condominium Association, Inc., an Alabama non-profit corporation (the “Association”). Any use of the swimming pool, fitness facility or any other of the common elements located at the Condominium shall be subject to the following: In consideration of being permitted to rent and occupy a unit at the Condominium, the Occupants, both for themselves and their respective spouses, children, legal representatives, heirs and assigns (sometimes hereinafter collectively referred to as the “Releasing Parties”), hereby release, remise, waive and discharge Stonehedge, LLC, an Alabama limited liability company, Heritage Rental Management Company, LLC, an Alabama limited liability company (the “Rental Company”), the Association, and all of the respective affiliates, directors, officers, members, managers, employees, and agents of any of the foregoing (sometimes hereinafter collectively referred to as the “Released Parties”) from any actions, suits, damages, claims or judgments which may arise out of or otherwise result from any injury to persons or property, and for any and all loss, damage or claim which may be sustained or claimed to have been sustained while the Releasing Parties were or are on the Condominium, regardless of the cause therefore. The Releasing Parties hereby acknowledge (a) use of the swimming pool and the fitness facility located at the Condominium may present a risk of harm and injury to persons or property; and (b) that he/she understands the risks, and fully assumes the risks of any such injuries or property damage. Without in any way limiting the foregoing, the Releasing Parties should consult a physician or other medical expert prior to using the swimming pool or fitness facility. To the fullest extent permitted by applicable law, the Releasing Parties further hereby agree to indemnify the Released Parties and hold each of the Released Parties harmless from any claim, loss, liability, damage, judgment or cost, including, but not limited to, attorney’s fees, of the Released Parties arising out of or otherwise related to the Releasing Parties’ entry and presence upon the Condominium (including, without limitation, the Releasing Parties’ use of the swimming pool and/or fitness facility. The Releasing Parties hereby expressly acknowledge and agree that the permission to enter upon the Condominium is conditional, temporary and subject to revocation by the Rental Company and/or the Association and that either the Rental Company or the Association may revoke any permission granted hereunder, or limit the same, for any reason and at any time, within the sole and absolute discretion of the Rental Company and/or the Association, as applicable. Each of the Occupants shall, upon his/her arrival at the Condominium for check-in, proceed immediately to the Clubhouse to obtain a written “Occupant Release”, which will be on the same terms and conditions as set forth in the immediately preceding paragraph, and shall execute such Occupant Release and deliver same to the Association and/or Rental Company staff member on duty in the Clubhouse. Execution and delivery of said Occupant Release by each of the Occupants shall be a condition precedent to each Occupant’s right to occupy a unit in the Condominium. Notwithstanding anything contained herein to the contrary, it shall be the absolute duty of each Occupant to execute and deliver said Occupant Release in accordance with the foregoing. The Occupants acknowledge and agree that in the event of any breach of the terms hereof by any of the Occupants, the Rental Company and/or the Association may invoke the jurisdiction of any court of law or equity that is situated in Baldwin County, Alabama, in order to obtain an injunction or any other remedy available to the Rental Company and/or the Association for the violation hereof or default hereunder by any or all of the Occupants.
